Wyoming Funeral Consumer Protection Laws

Wyoming layers its own rules on top of the federal ones, and several of them fit rural life here better than in any crowded state.

Water Cremation Has Been Legal Since 2014
Wyoming was an early mover. In 2014 the legislature amended the cremation statutes to define and authorize chemical disposition, the process by which a body is reduced to a powder using materials other than heat and evaporation. That is alkaline hydrolysis, also called water cremation or aquamation. It is a gentler, lower-energy option, and it is legal to arrange in Wyoming, not something families have to drive out of state to reach.
You Can Bury on Private Property
Most families use an established cemetery, but Wyoming allows burial on private land, which matters on a ranch or a family homestead. Check with the county or town clerk for local zoning first, draw a map of the burial ground and file it with the property deed so the spot stays clear to future owners, and obtain a burial-transit permit from the local registrar before anyone is buried.
Prepaid Money Must Sit in Trust or Escrow
A prepaid funeral contract in Wyoming has to be funded through a trust or escrow account, and only a licensed funeral director or a licensed insurance seller may sell one. The Wyoming Department of Insurance oversees preneed contracts. The protection is real, but request the account statement, because an escrow rule only works when families check it.
No Funeral Home May Require Embalming
Wyoming never requires embalming. A body must be embalmed or refrigerated only if final disposition will not happen within 36 hours, and refrigeration is a fully legal, lower-cost substitute (035-4 Wyo. Code R. 4-5). For a direct burial or direct cremation you can decline embalming entirely, and the funeral home must list the charge as a separate line item.
Cremation Waits 24 Hours, and the Family Decides
A body may not be cremated in under 24 hours unless the county coroner authorizes a waiver, and the next of kin authorizes the cremation. Wyoming also honors a written directive the person made themselves; a contrary written wish signed within three days controls (Wyo. Stat. 2-17-101). Written authorization is required before any cremation begins.
Verify Any Home, and the County Backstop
The Wyoming State Board of Funeral Service Practitioners licenses every funeral home and director in the state, and you can confirm a license through the board before you sign anything. And no family is left without options: a county may spend up to $1,500 on the burial or cremation of an indigent resident, so ask the funeral home to work to that cap when there is truly no money.

Water Cremation in Wyoming: Legal Since 2014

Wyoming is one of the earlier states to authorize water cremation. When the legislature amended the cremation statutes in 2014 to recognize chemical disposition, it opened the door to alkaline hydrolysis, a process that uses water, warmth, and an alkaline solution instead of flame to reduce a body to bone and a sterile liquid. It uses far less energy than flame cremation and returns the same kind of ashes to the family.

Because it is legal here, you do not have to arrange it out of state. Availability is still uneven across a state this size, so ask a funeral home directly whether it offers water cremation or works with a provider that does. Where it is offered, the price is usually close to flame cremation.

Green Burial in Wyoming

Green or natural burial skips the vault, the embalming, and the metal casket, and Wyoming law does not require any of them. The body is buried in a biodegradable casket or shroud so it returns to the earth naturally, and the total often lands well below a conventional burial.

Not every cemetery allows it, so ask whether a ground permits vault-free burial before you plan on it. A biodegradable casket shipped direct usually costs a fraction of the funeral home price.

Burial on Private Property in Wyoming

On a ranch or a family homestead, Wyoming lets you bury a loved one on your own land, a right that means far more in a state this rural than in a city. Start with the county or town clerk to confirm local zoning, since the rules vary place to place.

Once you have the go-ahead, draw a map of the burial ground and file it with the property deed so future owners know the spot is there, and get a burial-transit permit from the local registrar before the burial. A licensed funeral director can still handle the paperwork and transport if you want help with those steps.

Human Composting in Wyoming: Not Legal Yet

Human composting, also called natural organic reduction, is not authorized in Wyoming as of 2026. Only a small number of states have legalized it so far, and Wyoming is not among them.

Families set on this option arrange it through a licensed provider in a state that allows it, such as Colorado or Washington, and a Wyoming funeral director can help coordinate the transport. If it matters to you, ask your legislator, because the list of states grows most years.

How to Get a Death Certificate in Wyoming

In Wyoming a death certificate must be filed with the local registrar within three days of the death and before the body is removed from the state (Wyo. Stat. 35-1-418). The funeral home usually files it and orders your first copies as part of the arrangements.

The first certified copy costs $25 and each additional copy is $20 through the Wyoming Department of Health Vital Records office (307-777-7591).
