The federal FTC Funeral Rule applies in Ohio just as it does nationwide. Funeral homes must give you a General Price List at the start of any in-person discussion of arrangements, a Casket Price List before showing caskets, an Outer Burial Container Price List before showing vaults, and an itemized statement of selected goods and services. The Funeral Rule also prohibits charging for embalming you did not authorize, requiring purchase of a casket for direct cremation, or refusing to handle a casket purchased elsewhere. Ohio Has a Township-Trustee Indigent Burial System Most Families Never Hear About
If a family in Ohio cannot pay for a burial or cremation, the responsibility does not fall on the state and it does not fall on the county. It falls on the township trustees of the place where the deceased was a legal resident at the time of death, and it has worked this way for generations. Ohio Revised Code 9.15 places primary responsibility for indigent disposition on township trustees or municipal officers. ORC 5101.521 reimburses those local government entities up to $1,000 for an adult and up to $750 for a child. No other state in the country runs its indigent burial program this way.
The eligibility threshold is income at or below 150 percent of the federal poverty line for the family size. With 1,308 Ohio townships, each carrying independent authority subject to those statutory caps, Ohio operates the most decentralized indigent disposition system in the United States. The practical consequence: a family in acute crisis with no funds is calling township trustees, not a state hotline. There is no single 1-800 number. The application starts where the deceased lived.
One trade-off matters before the call. Because the township is the payor, the township decides whether disposition is burial or cremation. A non-paying family member cannot demand a specific type. Statute requires only a stone, metal, or concrete marker bearing name, age, and date of death. Families who want to upgrade pay the difference. Ohio Is the Only State Targeted by Three Separate FTC Funeral Home Sweeps
Between 2005 and 2011, the Federal Trade Commission ran undercover in-person inspections of Ohio funeral homes in three different metros, the only state in the country where that has happened. Across the three sweeps combined, 12 of 47 inspected funeral homes (25.5 percent) had Funeral Rule violations. The 2024 nationwide FTC phone sweep then flagged a Northeast Ohio provider, Gresser Funeral Home, for giving inconsistent prices to undercover staffers on separate calls. None of this is ancient history. It is the recurring pattern Ohio families navigate every time they pick up the phone.
The breakdown: the 2005 Columbus sweep inspected 12 funeral homes; 6 were in full compliance, 5 received compliance letters for lesser violations, and 1 was enrolled in the Funeral Rule Offenders Program. The 2009 Cincinnati and 2011 Cleveland sweeps together inspected 35 funeral homes and found 7 with significant violations. Not every funeral home will hand over the General Price List on first request. Not every funeral home will quote the same direct-cremation number twice in a week. Verify Every Ohio Funeral Home License Before You Sign

In 2022, a Lucas County jury convicted Shawnte Hardin on 31 felony counts for operating unlicensed funeral businesses across four Ohio counties: Cuyahoga, Summit, Franklin, and Lucas. Investigators removed two bodies from his Columbus operations in September 2021. In January 2022, more than 80 unreturned cremated remains were discovered in a church in Akron. Hardin had used passcodes belonging to licensed funeral directors to access the Ohio Department of Health Electronic Death Registration System. More than 50 witnesses testified that he deceived them into believing he was a licensed funeral director. He received 11 years and 10 months in prison. The Ohio Supreme Court upheld the conviction in State v. Hardin, 2024-Ohio-2943, the largest documented unlicensed funeral operation prosecution in Ohio history, prosecuted by the Ohio Attorney General.
