What a Funeral and Cremation Actually Cost in Mississippi, and What You Do Not Have to Pay

In March 2021 the Funeral Consumers Alliance asked twenty funeral homes around Jackson for their price list. Nine sent one. Eleven did not answer. Among the nine that did, a direct cremation ranged from $1,367 in Clinton to $2,695 in Ridgeland, and a full-service funeral ranged from $2,675 to $9,045. Same metro. Same week. Same service.

That spread is the single most useful fact on this page. It means the price you are quoted in Mississippi is not the price. It is one funeral home’s price, and the one down the road may be thousands less for work that is identical on paper.

Here is what the four main paths cost in Mississippi. The averages come from Funeralocity, a price aggregator, and every one of them sits below the national figure for the same service. The low column is different: those are prices that were actually published on a Mississippi price list or quoted by a low-cost provider network serving the state.

A note on what is missing from that table, because the honest answer matters more than a filled cell. Mississippi cemeteries do not publish standardized plot pricing, and no authoritative statewide source for it exists. Anyone quoting you a precise Mississippi plot average is guessing. Call the specific cemetery and ask for the plot price and the opening and closing fee as two separate numbers.

The other missing line item is the one almost every cost guide leaves out. Under Miss. Code Ann. Section 41-61-69(2), no body may be cremated in Mississippi until a medical examiner certifies that he has inquired into the cause and manner of death and sees no need for further examination. He is entitled to charge $25 for that signature. It has been $25 since 1993. It is small, it is real, and it should appear on your itemized statement rather than surface as a surprise.

Crime victims compensation: up to $6,500

If the death was caused by a violent crime, including a DUI crash, the Mississippi Victim Compensation Program through the Attorney General’s Bureau of Victim Assistance covers funeral expenses up to $6,500, plus up to $800 for transportation to make arrangements or attend the service. The total award across all categories caps at $20,000. The crime has to have been reported to law enforcement within 72 hours, or good cause shown, and the application has to arrive within 36 months of the report. Call 601-359-6766 or 800-829-6766.

One warning worth putting in bold terms: the Mississippi Bar’s own public information page currently tells people the funeral cap is $3,500. That figure is stale. The Attorney General’s 2025 brochure says $6,500, and the state administrative rule agrees. If someone quotes you $3,500, they are reading an old page.

County indigent burial: no statewide cap, and that cuts both ways

Miss. Code Ann. Section 43-31-29 requires every Mississippi county board of supervisors to decently bury paupers found in the county, and requires each board to establish a written indigent burial policy and record it in the board minutes. What it does not do is set a dollar amount. The board “may then pay the full cost of burial or may contribute funds to assist in the cost.”

So there is no Mississippi number to quote you. What a family receives depends entirely on which of the 82 counties the person passed in, and on that county’s written policy. That policy is a public record by statute. Call the county board of supervisors where the death occurred and ask them to read you the indigent burial policy from the minutes. Mississippi’s statutes contemplate cremation as well as burial here, so ask about both.

Line of duty: up to $15,000

If the person served in law enforcement, firefighting, or a similar public safety role and passed in the line of duty, the Mississippi Department of Public Safety Death Benefits Trust pays funeral expenses up to $15,000 on Form DB-030. Eligibility is narrow and worth confirming with DPS directly before counting on it.

Social Security: $255

The federal lump sum death payment is $255, one time, generally to a surviving spouse who was living with the person, or in some cases to a minor child. It has been $255 since 1954. Against a Mississippi direct cremation at the state average, it covers about an eighth of the cheapest option. Take it, but do not plan around it.

Read that again. Any person. Not just a buyer. Not just in person. That means a Mississippi funeral home refusing to give you a price list is not only violating federal law, it is violating the terms of the license the state hands it. You do not have to write to Washington. You can file with the board that can take the license away.

Mississippi Funeral Consumer Protection Laws

Four Mississippi laws do real work for families, and one of them is defined by what it leaves out.

One structural quirk worth knowing, because it explains why Mississippi funeral law changes more often than most. Every substantive section of the state’s funeral licensing chapter carries an automatic sunset. Sections 73-11-41 through 73-11-73 are currently tagged repealed effective July 1, 2029, and the legislature has to affirmatively reenact them. It has done so in 2005, 2012, 2017, 2021, and twice in 2025. The law is not going away. It just gets reopened for amendment on a fixed cycle, so a rule you confirmed three years ago is worth confirming again.

Who Decides What Happens in Mississippi

Mississippi answers this question more clearly than most states, and the answer is unusually good news if you write anything down.

Miss. Code Ann. Section 73-11-58(1): “Residents of the state shall have the right to direct their own disposition without interference from others, regardless of their relationship. This right of self-authorization can be executed through the use of the Self-Directed Disposition Authorization document. This document shall supersede the wishes and rights commonly executed by the next of kin.”

That is the statute’s own language, and it settles the argument before it starts. In the state with the lowest cremation rate in the country, where choosing cremation often means choosing against what the family expects, a written Self-Directed Disposition Authorization is worth more in Mississippi than it is almost anywhere else. If you want cremation here, put it in writing and the statute will back you.

If nothing was written down

The priority ladder in Section 73-11-58 runs in order, and the top rung will surprise people. First is not the spouse. First is the person named on the decedent’s DD Form 93, the Record of Emergency Data, if the person passed during service in any branch of the Armed Forces, the Reserves, or the National Guard. That designation outranks the surviving spouse and everyone below. For a Mississippi service member, the DD Form 93 is the most powerful disposition document in the state, and almost nobody knows it.

After that: the surviving spouse, an adult child, an adult grandchild, either parent, an adult sibling, then down through guardians, degrees of kinship, and finally anyone willing to assume responsibility.

Three clocks nobody mentions

• Five days. Anyone on the priority list who does not exercise the right within five days of the death is deemed to have waived it, and cannot contest the disposition afterward.
• Ten days. If no consent arrives from anyone on the list within ten days, the county coroner is authorized to sign it instead.
• Twenty days. If people in the same priority class disagree in writing, the funeral home follows the greatest number of consents. On a tie, the earlier consent controls unless someone gets a court order filed and paid for within twenty days of the death.

There is one more provision worth naming plainly. A person finally adjudicated by a court to be at fault for the death, criminally or civilly, is barred from deciding what happens to the body, regardless of where they sit on the ladder. A chancellor then designates the next available person, and may require a $5,000 bond if a criminal prosecution is still running.

Burial Associations in Mississippi: The $450 Ceiling

This section exists because of a specific Mississippi conversation that happens at kitchen tables and almost never on websites. Someone says grandmother has a burial policy. She has been paying on it faithfully for thirty years. The family assumes the funeral is handled.

Mississippi has a death care instrument most states do not: the burial association, regulated by neither the funeral board nor the Secretary of State, but by the Mississippi Insurance Department. Here is what the regulator says about it, in its own words.

“According to Mississippi law, a burial association may offer contracts in three amounts: $150, $300, and $450. Regardless of how much money is paid in premium, the contract only pays the face amount at the insured’s death.” And: “Burial contracts require payments throughout the member’s lifetime and do not pay up before the member’s death.” And: “Under the law, if you discontinue paying premiums there is no refund or cash settlement you are entitled to receive.”

Put those three sentences together. The maximum a Mississippi burial association contract can pay is $450, which is roughly a quarter of the state’s average direct cremation and about five percent of an average traditional burial. The premiums never stop. If they ever do stop, the money is simply gone, with no cash value. And the contract pays the funeral home named on it, not the family.

The Insurance Department is candid about the consequence: “the average cost of most funerals today far exceeds a single burial contract amount. As a result, several burial contracts may be purchased to pay the expenses of the funeral home you want to provide the service.”

The fifty-mile rule, which is worth real money

Buried in Miss. Code Ann. Section 83-37-13(8) is a provision the Insurance Department documents and few families ever hear. For Class A burial contracts written in 1974 or later:

• If the death happens more than 50 miles from any location of the funeral home named in the contract, and the beneficiary chooses a different funeral home, the association must pay in cash at least 50 percent of the face amount, or return the premiums paid, whichever is greater.
• If the death or burial happens within 50 miles of the named home and the family wants someone else, the association only has to return the premiums paid, capped at the face amount.
• Class A contracts written before 1974 carry no such provision at all.

The regulator’s own advice is the right advice: ask the funeral home, in advance and out loud, exactly how much it will pay toward the funeral if the next of kin does not use the home named in the contract. Some associations have mutual agreements to pay the full face amount to another home. Some will not. Complaints about a burial contract go to the Mississippi Insurance Department at P.O. Box 79, Jackson, MS 39205. Not the funeral board. Not the Secretary of State.

Where to File a Mississippi Complaint

Mississippi splits death care regulation across three separate agencies. Filing with the wrong one costs you weeks you do not have. This table is the whole answer.

Two things to do before you sign anything

First, run the name through the board’s license verification search. It is free and it takes a minute. Mississippi licenses funeral establishments, directors, embalmers, crematories, certified crematory operators, and even retail casket sellers, who must register with the board annually.

Second, if a prepaid plan is on the table, check the Secretary of State’s enforcement actions list. Signed consent orders under the Preneed Act are published there as PDFs. This matters more in Mississippi than the abstract advice suggests, and the next section explains why.

How a board complaint actually runs, including the part that can cost you

The process is set out in Miss. Code Ann. Section 73-11-57(2). Anyone may file, on the board’s form. The board serves the licensee by certified mail. The licensee has 20 days to answer in writing, copying you. The board investigates, and on finding reasonable cause may order a hearing with 20 days’ notice. Both sides may bring counsel, you present first, and the board decides within 90 days of the hearing closing.

Now the sentence that belongs in every Mississippi consumer guide and appears in none of them. From Section 73-11-57(2)(d): “If the complainant fails to attend a hearing without good cause shown, the complaint shall be dismissed summarily and all fees and expenses of convening the hearing shall be assessed to, and paid by, the complainant.”

A grieving Mississippi family that files a complaint, gets a hearing date, and then cannot face showing up can be billed for the cost of convening it. That is not a reason to stay silent. It is a reason to only file when you intend to see it through, and to tell the board immediately if you cannot make a date.

It is also worth calibrating expectations on the penalty. Under Section 73-11-57(6), the board can fine a first violation up to $500, a second up to $1,000, and a third or later violation up to $5,000. Those are small numbers against a five-figure funeral. The fine is not the point. The license is. The board can suspend or revoke it, and it is the only thing on the table a funeral home cannot afford to lose.

A direct cremation averages $1,994 in Mississippi. That is the number to hold in your head, and then immediately distrust, because the average is doing more hiding than telling. In the 2021 Funeral Consumers Alliance survey of the Jackson metro, the nine homes that published a price ranged from $1,367 to $2,695 for the same direct cremation. On the Gulf Coast, low-cost provider networks quote from $895 in Biloxi and Gulfport.

That spread is not an accident, and it is the most Mississippi thing on this page. In a state where most families still choose burial, cremation pricing has never been competed down to a norm the way it has in Arizona or Florida. Thin demand means wide prices. Which means the highest-value thing you can do in the next hour is call three funeral homes and ask one question: what is your price for a direct cremation? In Jackson in 2021, that call was worth $1,328.

Prices in that table come from Funeralocity for the averages and from a low-cost provider network for the starting figures, both flagged here as aggregator and commercial sources rather than published price lists. The $1,367 is different: that one was on a real Mississippi general price list. Ask for a general price list and you turn every estimate on this page into a fact.

Most Mississippi families still choose burial, which makes this comparison less obvious here than it is in most of the country. Here is the arithmetic without the culture attached to it.

The table above compares two choices at today’s prices. It does not compare today’s price against the price whenever this actually happens, which for most people reading this is years away. That gap is the one worth measuring.

Why Cremation Prices Keep Rising in Mississippi

Mississippi holds a distinction no other state does right now. It is the only state in the country with a cremation rate still below 40 percent. In 2020 the rate here was 29.1 percent, the lowest in America, while the country as a whole was already past 56 percent. CANA projected Mississippi would reach 37.9 percent by 2025, and its 2026 report confirms Mississippi is the last state under the 40 percent line. Alabama and Kentucky both crossed it.

Two things follow from that gap, and both cost Mississippi families money.

The first is pricing. Cremation is a commodity service almost everywhere else in America, competed down to a tight band. In Mississippi it is still a minority choice, so the band never tightened. A 1.97x spread on direct cremation and a 3.38x spread on a full-service funeral, inside one metro, is what a market without price pressure looks like. You are the price pressure. Three phone calls is the whole strategy.

The second is distance. Every Mississippi crematory has to be separately licensed under Miss. Code Ann. Section 73-11-69, inspected by the board each licensure period, and run by a certified crematory operator. In the country’s lowest cremation state, there are correspondingly fewer of them, which turns into transport miles on your itemized statement. Ask whether the crematory fee and the transport are included in the quoted price, because in Mississippi they are more often not.

And it means one more thing, softer but truer. Choosing cremation in Mississippi is often choosing against what your family and your church expect. The statute anticipated exactly this. Section 73-11-63 expressly says the chapter does not interfere with religious ceremonies or customs, and Section 73-11-58 gives a written Self-Directed Disposition Authorization the power to supersede next of kin. In the state where cremation is least expected, the piece of paper that guarantees your wishes is worth the most.

Choosing an Urn in Mississippi

The urn is the one line item where the funeral home’s markup is easiest to sidestep and hardest to notice. Federal law says you may buy one anywhere and the funeral home has to accept it without a handling fee. Two options at opposite ends, both of which ship to any Mississippi funeral home.

Water Cremation in Mississippi

Water cremation, also called alkaline hydrolysis or aquamation, is not available in Mississippi. The precise reason matters, because it is not what most people assume.

Mississippi has not banned it. Mississippi has no law about it at all. The Cremation Association of North America lists 26 states where alkaline hydrolysis is legal as of March 2026, and Mississippi is not among them. Nolo’s state tracker records the position exactly: “Mississippi does not currently have any laws or regulations about alkaline hydrolysis.”

That absence is what stops it. Miss. Code Ann. Section 73-11-69 licenses crematory facilities and requires a certified operator for the retort, language written around flame cremation. With no authorizing statute, there is no licensure path for an alkaline hydrolysis facility, and so there is no Mississippi provider.

The out of state path

Four of Mississippi’s neighbors have legalized it: Alabama, Tennessee, Georgia and Florida. Two of them share a border. Alabama sits directly east, and Tennessee sits directly north, with the Memphis metro minutes from the DeSoto County line and already serving Southaven, Olive Branch and Hernando. Louisiana and Arkansas have not legalized it, so west is not an option.

The practical route is to ask a Mississippi funeral director to arrange transport to an Alabama or Tennessee provider. We have not verified a specific out-of-state provider or its pricing for Mississippi families, so we are not going to print a number we cannot stand behind. Ask the provider directly for its price list and whether transport from your county is included, because that transport is where the cost hides.

Green Burial in Mississippi

Mississippi has zero green burial grounds. Not zero Green Burial Council certified grounds, which would be the usual careful hedge. Zero of any kind: no conservation ground, no dedicated natural burial ground, and not even a hybrid section inside a conventional cemetery. Every green burial directory checked returns nothing for Mississippi.

And yet nothing in Mississippi law obstructs green burial. That is the strange part, and it is worth stating plainly because it points at the way through.

• No embalming requirement. Refrigeration is an express alternative under 15 Miss. Code R. 5-85-4.6.3.
• No state casket or vault requirement. No Mississippi statute requires either one. Where a vault is required, that is the cemetery’s own bylaw.
• Alternative containers must be accepted. The FTC Funeral Rule requires it, and Miss. Code Ann. Section 73-11-61 writes that rule into Mississippi licensing law.
• Private property burial is legal, subject to a county petition.

So the barrier in Mississippi is not the law. It is that no one has dedicated the land. Which leaves two real paths.

Path one: ask a conventional cemetery to waive the vault

Because the vault requirement is cemetery policy rather than state law, it is a question you are allowed to ask. Call the cemetery and ask whether it will accept a shroud or a biodegradable container without an outer burial container. Some Mississippi cemeteries reportedly accommodate this. We could not verify a specific one by name, so we are not going to name one and send you on a wasted drive. Call and ask, and get the answer from the cemetery rather than the funeral home.

Path two: private property, which is the cleanest route in Mississippi

Under Miss. Code Ann. Section 41-43-1(2), a county board of supervisors may establish or designate the location of a private family cemetery upon petition. One siting rule applies: no new cemetery within 500 yards of a hospital or overnight medical facility without written approval. Land used for burial in violation is deemed a common nuisance.

Pair that with Miss. Code Ann. Section 73-11-65, which permits a family to bury its own dead without charge, and private property burial becomes the clearest legal path in Mississippi to a family-directed, no-vault, no-cemetery-fee burial. It is also the cheapest, because it removes the cemetery from the arithmetic entirely.

One caution, offered honestly rather than confidently. Section 73-11-65 is two sentences long. It requires every funeral service or interment, or part thereof, to be under the supervision of a Mississippi licensee, and then carves out the family burying its own dead without charge. The statute does not define family, does not define without charge, and uses the word burying rather than naming cremation. No board rule or Attorney General opinion construing it was found. Mississippi is not a state where you should assume a home funeral is fine because a website said so. Call the State Board of Funeral Service at 601-932-1973 and get the scope of that exception from the people who enforce it, before you rely on it.

Eco and Biodegradable Caskets for Mississippi

Whichever of those two paths you take, the container is yours to choose and the funeral home has to accept it. Buying it direct is usually the difference between a few hundred dollars and a few thousand.

Human Composting in Mississippi

Human composting, formally natural organic reduction, is not legal in Mississippi. Fourteen states have legalized it, starting with Washington in 2019 and most recently New Jersey in September 2025. Mississippi is not among them, and unlike Utah, Illinois and New Hampshire, Mississippi does not currently have a bill pending either.

The nearest state where it is legal is Georgia, which legalized it in May 2025. That is a long way to move someone, and the transport cost is real. If natural organic reduction is what you want and you live in Mississippi, the honest answer today is that green burial on private property gets you closer to the same goal, at a fraction of the cost, and it is legal here right now.

How to Get a Death Certificate in Mississippi

A Mississippi death certificate costs $17 for the first certified copy and $6 for each additional copy ordered at the same time. Order them together. A second copy ordered later costs the full $17 again, so the extras are worth buying in the first envelope.

That $17 figure matters more than it looks, because the top of Google currently carries at least two wrong Mississippi prices. Everplans still publishes $15 and $5. An archived NCHS mirror still lists $2. The $17 and $6 come from the Mississippi State Department of Health’s own application instructions and are confirmed independently by the CDC’s vital records listing and by VitalChek.

The Mississippi detail nobody connects

In Mississippi the death certificate is not paperwork you gather afterward. It is the gate on cremation. Under 15 Miss. Code R. 5-85-4.7.2: “No body shall be cremated unless the death certificate has first been completed and filed with the Office of Vital Records of the Department of Health.”

That is why there is no cremation waiting period in Mississippi and why cremations here can still take days. The clock is not statutory. The clock is however long it takes a physician or medical examiner to certify cause of death and the funeral director to file. If you are being told to wait, the useful question is not how long the law requires. It is where the certificate is right now, and who is holding it.

Mississippi cemeteries do not publish standardized pricing, and no authoritative statewide source for plot costs exists. Call the specific ground and ask for two figures separately: the plot, and the opening and closing. Ask a third question too, whether a vault is required, because in Mississippi that is the cemetery’s own bylaw and not state law.

Mississippi Veterans Cemeteries

Mississippi is well covered here, and the geography is worth naming. The three VA national cemeteries sit at three corners of the state: Biloxi on the Gulf Coast, Corinth in the far northeast, Natchez in the southwest on the river. The two state veterans cemeteries, Newton and Kilmichael, fill in the middle. A Mississippi veteran’s family is rarely more than about two hours from a no-cost burial option.

The DD Form 93 point, which almost no Mississippi page makes

This is the single most useful veteran-specific fact on this page. Under Miss. Code Ann. Section 73-11-58(1)(a), if a Mississippi decedent passed during service in any branch of the Armed Forces, the Reserves, or the National Guard, the person named on their DD Form 93, the Record of Emergency Data, holds first priority to direct disposition. Mississippi wrote that into state law citing Public Law 109-163 Section 564 and 10 USC Section 1481. If you are serving and you live in Mississippi, your DD Form 93 is not a formality buried in a personnel file. It is the most powerful disposition document you have in this state. Headstones and Grave Markers in Mississippi

A marker bought through the cemetery or the funeral home is one of the largest markups in the whole transaction, and one of the easiest to route around. The cemetery has to accept an outside marker that meets its size and material rules; ask for those rules in writing before you order.

Cremation in Mississippi: How It Works

There is no waiting period. That sentence contradicts several of the top results for this question, so here is the basis for it. Section 73-11-69, which licenses and regulates every Mississippi crematory, was read in full: no minimum hold time appears anywhere in it. Section 73-11-73 requires consent but sets no clock. The 48-hour rule people cite from 15 Miss. Code R. 5-85-4.6.3 is a maximum before disposition, not a minimum before cremation, and it is waived by embalming or refrigeration. The widely repeated claim that Mississippi requires a mandatory 24-hour wait is not supported by any Mississippi statute or rule.

What actually gates a Mississippi cremation is paperwork and a signature.

• Consent. Miss. Code Ann. Section 73-11-73 bars any licensee from cremating without the prior written or oral consent of the next of kin or authorizing agent. Oral consent has to be documented with who gave it, their relationship, the date and time, and who took it.
• Medical examiner certification. Under Miss. Code Ann. Section 41-61-69(2), no body may be cremated unless a medical examiner certifies he has inquired into cause and manner of death and sees no need for further examination. The fee is $25, paid by the applicant. Cremating without permission where the medical examiner has jurisdiction is a misdemeanor.
• The death certificate, filed. Under 15 Miss. Code R. 5-85-4.7.2, no body may be cremated until the death certificate has been completed and filed with the Office of Vital Records.
• A licensed crematory and a certified operator. Section 73-11-69 requires the facility to be separately licensed, inspected by the board each licensure period, and operated by a certified crematory operator. Section 73-11-71 separately prohibits intermingling cremated remains.

So when a Mississippi funeral home tells you the cremation cannot happen yet, the honest follow-up is not how long the wait is. It is which of those four things is outstanding, and who you can call about it.

• Write the Self-Directed Disposition Authorization. Miss. Code Ann. Section 73-11-58(1) says it supersedes the wishes of next of kin. In the state with the lowest cremation rate in America, that document is the difference between your wishes and a debate.
• Check who is on your DD Form 93 if you serve or have served. In Mississippi that designation outranks your spouse.
• Verify registration before you prepay a dollar. Call the Secretary of State at 601-359-9055 and check the enforcement actions list. Mississippi’s Loss Recovery Fund reimburses losses caused by a registered provider, and that word is the whole sentence.
• Read the cancellation terms out loud. Mississippi law gives you no statutory right to cancel a preneed contract. Whatever your contract says on that point is all the protection you have.

And one thing to look at with clear eyes. If there is a burial association contract in the family, find out its face amount. Mississippi law caps it at $450, the premiums never stop, and there is no cash value if payments lapse. It is not nothing. It is also not a funeral, and a family that discovers the difference during the week someone passed is discovering it at the worst possible time.
