New York Funeral Consumer Protection Laws
New York runs one of the most consumer-protective funeral regulatory regimes in the country. Three statutes matter most for families in the first 72 hours after a death.
The 72-hour disposition rule (Public Health Law section 4144). No body may be interred, cremated, or otherwise disposed of, or held pending further disposition, more than 72 hours after death without a properly issued burial, removal, or disposition permit from the local registrar of vital statistics. New York does not require embalming by statute. The strongest pre-need trust law in the nation (General Business Law section 453). Under GBL 453 and Public Health Law section 3442, 100 percent of pre-paid funeral funds must be deposited within 10 business days into an interest-bearing, government-backed trust account. Principal and interest stay consumer property. Revocable accounts can be canceled at any time, for any reason, with full refund of principal and earned interest, no penalty. If the funeral home closes, customers receive 30-day written notice and funds transfer to a separate institution in the customer’s name.
